Copyright Policy

Introduction

This Copyright Policy ("Policy") establishes and governs the protection of intellectual property rights on Tycoon Hamlet's ("we", "us", or "our") website, applications, and services (collectively, the "Services"). Response to Copyright Claims

Upon receipt of a valid notice of claimed infringement, we will:

  1. Promptly remove or disable access to the allegedly infringing material
  2. Make a reasonable attempt to notify the user who posted the material
  3. Take appropriate measures against repeat infringers, which may include account termination

Counter-Notice Procedure

If you believe your content was removed due to a mistake or misidentification, you may submit a counter-notice containing:

  1. Your physical or electronic signature
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the courts in India and that you will accept service of process from the person who provided the original notification

Repeat Infringer Policy

We maintain a policy to terminate, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. A repeat infringer is a user who has been notified of infringing activity multiple times and/or has had content removed from our Services multiple times. We reserve the right to determine, in our sole discretion, whether a user is a repeat infringer and to take whatever action we deem appropriate.

Fair Dealing

We recognize the doctrine of fair dealing as established by relevant copyright law, which permits limited use of copyrighted material without permission for purposes such as private study, research, criticism, review, and news reporting. We will evaluate claims of fair dealing on a case-by-case basis in accordance with applicable copyright laws strictly on requests.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TYCOON HAMLET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  1. YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICES
  2. ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN
  3. ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT
  4. ANY CONTENT OBTAINED FROM THE SERVICES
  5. UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

THIS LIMITATION OF LIABILITY APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF TYCOON HAMLET HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

Indemnification

You agree to defend, indemnify, and hold harmless Tycoon Hamlet, its officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:

  1. Your use of the Services
  2. Your content published through the Services
  3. Your violation of this Copyright Policy or our Terms of Service
  4. Your violation of any rights of a third party, including intellectual property rights

This indemnification obligation will survive the termination of your access to or use of our Services and the termination of this Policy.

Governing Law

This Policy shall be governed by and construed in accordance with domestic laws. Any disputes arising under or in connection with this Policy shall be subject to the exclusive jurisdiction of the courts located in Uttar Pradesh.
